TERMS OF SERVICE AND LIABILITY WAIVER AGREEMENT

This Terms of Service and Liability Waiver Agreement (the “Agreement”) constitutes a binding legal contract between Southern WV Clean Paws Pet Waste Removal Services (hereinafter referred to as the “Company”) and the undersigned client (hereinafter referred to as the “Client”). By electing to have the Company provide lawn treatments, pet waste removal, kennel/litter box cleaning, or any other property maintenance services, the Client explicitly acknowledges that they have read, thoroughly understand, and unconditionally agree to all terms, conditions, and liability waivers set forth below.

1. Scope of Services

The Company provides premium, cost-effective solutions for residential and commercial properties, including pet waste removal from lawns, cleaning of dog kennels and litter boxes, and specialized lawn tick repellent applications. These services are designed to improve property sanitation and significantly reduce the stress and health risks associated with tick-borne illnesses, such as Lyme Disease and Alpha-gal Syndrome (lone star tick allergy).

2. Pre-Service Requirements & Property Preparation

To ensure the safety of our personnel and the maximum effectiveness of the treatment, the Client must comply strictly with the following preparation rules before any service can be performed:

• Lawn Maintenance: The Client’s lawn must be completely mowed and manicured at least three (3) days prior to the scheduled application date. Overgrown grass severely compromises the efficiency and safety of tick repellent applications.

• Pet Restraint & Exclusion: ALL PETS AND ANIMALS ARE STRICTLY PROHIBITED FROM ENTERING THE PROPERTY YARD OR TREATMENT AREA while the Company is actively performing services. It is the Client’s absolute responsibility to secure all animals indoors or off-site prior to the technician’s arrival.

• Water Supply Access: The Client agrees to provide reliable access to an outdoor water source (spigot/hose hookup) on the property necessary for the proper mixing and application of the treatment.

3. Tick Repellent Application & Post-Treatment Care

The tick repellent application is a chemical/biological agent applied to the lawn to control tick populations. While highly effective at mitigating health risks like Lyme Disease and Alpha-gal Syndrome, the application requires strict post-treatment adherence:

• Mandatory Dry Time: THE TREATED LAWN MUST BE COMPLETELY AND THOROUGHLY DRY BEFORE RELEASING ANY PETS, DOMESTIC ANIMALS, OR LIVESTOCK BACK ONTO THE LAWN.

• Variability of Dry Times: The Client understands and acknowledges that drying times vary substantially based on local weather conditions, including humidity, sunlight, ambient temperature, wind, and shade density. The Client must personally inspect the lawn to ensure it is 100% dry prior to animal exposure.

⚠️ CRITICAL ANIMAL SAFETY NOTICE & LIABILITY RELEASE:

Failure to fully comply with the mandatory drying time restriction carries extreme risks. If animals are permitted onto a damp or wet treated lawn, the pets/animals may become severely sick, suffer neurological or systemic injury, or it can be fatal to the pets/animals.

By signing below or authorizing service, the Client explicitly assumes all responsibility and waives any and all rights to pursue legal action, damages, claims, or financial compensation against Southern WV Clean Paws Pet Waste Removal Services, its owners, operators, and employees, as a result of the repellent application. The Company cannot and shall not be held liable or responsible in any way for animal illness or mortality.

4. Master Binding Clause for All Services

The Client explicitly understands, covenants, and agrees that by hiring Southern WV Clean Paws Pet Waste Removal Services for ANY service (including but not limited to pet waste scooping, kennel cleaning, or tick repellent application), they fully agree to all terms outlined in this document. The Client acknowledges that this entire agreement stands good, valid, and enforceable in any court of law and shall act as an absolute bar and prohibition against any legal, civil, or insurance claims submitted by the Client, their estate, or representatives.

CLIENT ACKNOWLEDGMENT: I have read this document in its entirety. I fully understand the pre-service instructions (manicured lawn 3 days prior, water access, and absolute containment of animals during service) and the critical post-service safety requirement (lawn must be completely dry before letting animals out). I recognize the fatal risk to my pets if these terms are violated, and I fully release Southern WV Clean Paws from any liability.
